Benefits of an Uncontested Divorce

These days, many states allow couples to have a simple uncontested separation. This is how most couples divorce. It is simple, inexpensive, and preserves dignity and privacy for both spouses.

Uncontested divorces are expensive, no matter what you call it. However, if you need to divorce, you will be able to save time, money, and heartache. You don't need to make the divorce more complicated than it is.

Uncontested divorce is not recommended if there are still contentious issues in your marriage (e.g. child custody). You will need to ensure that your rights and those your children have are protected. Uncontested divorce is not possible in certain states if there are minor children.

If you and your soon to be ex-spouse have been on good terms and don't need to be married anymore and if child custody issues are resolved between you, an uncontested divorce will be much easier. Although divorce is difficult, an uncontested divorce can make it easier.

Divorce is not without its privacy issues. If the divorce is not contested, any disclosures you make to one another don't need to be public records. However, the agreement you make must be made public.

Contrarily, contested divorce will likely have every nuance of the separation publicized because the spouses are in a major fight with one another. If you wish to keep your privacy, you can work out the details between you and make the final agreements public. Not every discussion. This is also easier for your children.

You can agree to a divorce without your spouse. Perhaps you can't. You may not be able to. You may find that your spouse will be more willing to accept an uncontested divorce if they are presented with the differences between navigating through a divorce proceeding.

It is important to note that you do not have to agree on the reasons for the divorce to make it uncontested. Uncontested divorce is possible if you agree on the terms. It may seem obvious that you are unable to manage an uncontested divorcement.

After some time passes and your tempers have calmed down, you might decide that an uncontested divorce is the best option for you. Consider the costs to you and your children and decide if a flat fee divorce is best for you.
